One can imagine the administrations apologists would be singing a different tune if say President Hillary had approved this. In either case it is simple illegal. It is still illegal. It doesn't matter if they're listening in. It is a violation of the Fourth Amendment, pure and simple. You can argue the effectiveness of the program if you prefer.
